Terms and conditions of the online store "boo-care.si"
The Terms of Business determine the terms of use of the online store "the BOO CARE" on the website www.boo-care.si (hereinafter referred to as the "online store"), which is operated by Bastard 9 doo, Stara cesta 96D, 1370 Logatec. (hereinafter referred to as the "provider").
The terms and conditions of the online store are drawn up in accordance with the Consumer Protection Act (ZVPot), the recommendations of the Chamber of Commerce and Industry, general codes of electronic commerce and the Electronic Commerce on the Market Act (ZEPT).
General
The online store allows you to purchase cosmetics and other products for pets remotely.
An online store user is an individual who visits the online store and has the right to make a purchase.
A buyer is a user who makes a purchase through the "the BOO CARE" online store.
The provider undertakes to ensure that the following information is always available to the buyer:
- company identity (company name and registered office, registration number),
- contact information that allows the user to communicate with the provider,
- essential characteristics of the goods,
- conditions, costs and possible methods of delivery of goods,
- clearly and unambiguously set prices,
- possible payment methods,
- the validity period of the offer and the conditions and deadlines for withdrawing from the contract,
- appeal procedure.

Offer and prices
Due to the nature of online business, the online store's offerings change and are updated quickly and frequently. Despite our efforts to provide up-to-date and accurate information on the online store, the possibility of incorrect information about price or availability cannot be ruled out.
In these rare cases, or in cases where the price or availability status of the supplier changes during the order processing itself, the provider will allow the buyer to withdraw from the purchase or offer him the best option to resolve the situation.
All promotions and discounts published on the online store are valid exclusively for purchases or orders made online.
Our offer does not encourage excessive shopping or uncritical use of products.
When using it, you must adhere to the recommended dosages and instructions for use.
The purchase contract between the provider and the buyer is concluded at the moment of confirmation of the order by the provider (at the moment of receiving the email message "Your BOO CARE order has been accepted!").
The concluded order/contract is kept by the provider. Contracts and invoices are kept in accordance with the law and are available to buyers at the provider's headquarters upon request (a few days before the viewing).
All prices include VAT.
Prices are valid at the time of placing the order and have no predetermined validity. Prices are valid in the case of payment using the published possible payment methods.
In the case of payment by debit or credit card, the following conditions also apply:
- the payer must be the same person or organization that owns the payment card,
- After placing the order, it is not possible to change the content of the order or the final amount of the order, except in special cases determined by the provider.
Payment for ordered products
You can pay for products ordered in the online store:
- by pro forma invoice (e-bank, payment slip, etc.) – the pro forma invoice must be paid within 48 hours, otherwise your order will be canceled;
- with credit cards (Mastercard, Visa, American Express) processed by Stripe Payments Europe, Ltd;

Tax certification of invoices

Deadline and delivery of ordered products
Products ordered in the online store are delivered by Pošta Slovenije. If you order by 1:00 PM, the products are expected to be shipped the same day.
Due to the current situation with the Covid-19 virus, delivery times may be extended. We are working with delivery services to ensure that you receive your ordered products as soon as possible.
If the postman determines that he will not be able to deliver the package to you, he will leave a receipt for you to pick up at the selected post office. If you do not wish to pick up the package at the selected post office, you can request redelivery by calling the phone number on the receipt. Redelivery is free of charge.

Slovenian Post offers you fast and reliable delivery.
The postman will deliver the package to your chosen delivery address. The delivery time via Pošta Slovenije is 1-3 days.
You can order a package to be delivered to your home, work, friend, neighbor, selected post office or selected Petrol gas stations. Packages can be picked up at more than 550 Pošta Slovenije locations and 113 Petrol gas station locations. If you are not there when the package is delivered, you will receive a notification in your mailbox, allowing you to pick up the package together with your ID at the nearest post office.
If you do not want to receive the package at home, Pošta Slovenije allows you to pick it up at any Post Office and at selected Petrol gas stations. In the case of delivery to the desired post office, you will not receive a notification that the package has arrived.
Slovenian Post will inform you about the progress of the delivery via SMS and e-mail in the following ways:
- in the morning, when the package is ready for delivery, for pick-up at the post office or for transport to the selected gas station;
- upon delivery, if the recipient is not at the address. We will inform them that the package is waiting for them at the post office, so that they can pick it up on their way home. Of course, we will also leave a notification in their mailbox about the arrival of the package, just as before;
- with an e-notification when the package is delivered.
The merchant enables purchases to all customers from other EU member states under the same conditions as Slovenian customers. Delivery of products is only possible within the Republic of Slovenia.
Purchase process
I. Product selection: On the website www.boo-care.si, select the product and click on the ''Add to cart'' link. The system will inform you that the product has been successfully added to the cart. If you want to continue shopping, click on the ''Close'' cross in the top right and you will return to the online store. If you want to complete your purchase, click on the ''View cart'' link below and the system will take you to the shopping cart.
II. Removing a product from the shopping cart: On the website www.boo-care.si, in the upper right corner, there is a shopping cart icon, in which (after clicking on the icon) the user is shown the products that they added to the shopping cart while browsing the online store. If the user wants to remove a specific product from the shopping cart, they must click on the cart icon and cross ''remove'' or with the sign "+" increase or "-" decrease the quantity of products that you want to order . If the user wants to add a specific product to the cart, they must click on the cross ''Close'' in the upper right. By clicking on the said cross, they return to the online store.
III. Shopping Cart: To complete your order, you must click on the "Proceed to Checkout" icon and fill in the required fields.
- 1. Delivery address: You must provide the required contact information marked with a red asterisk (name, surname, e-mail address, address, city, postal code and phone number), which we need to confirm and complete the order and deliver the product.
- 2. Delivery cost: The user can choose delivery with Pošta Slovenije
- 3. Payment method: You can choose from five payment methods: Direct bank transfer, Cash on delivery, Paypal payment or credit cards.
- 4. Order details: Displays the products that the user added to the shopping cart while browsing the online store, the product price, delivery cost, payment method, and the total amount and VAT amount.
IV. Order completion: The user can review the submitted delivery information, the payment method he has chosen and the contents of the shopping cart. The user confirms the order by clicking on the 'Place order' button. If the order has been successfully completed, the text ''Your order was successful. Thank you for your purchase! Your order number is: xxxx.''
Purchase notification process
- After placing an order, the buyer receives a notification by email that the order has been accepted.
- Bastard 9 may call the customer on their contact telephone number to verify data or to ensure the accuracy of delivery.
- The purchase process for legal entities is exactly the same as for individuals, except that at the end of the purchase, you must enter the company name and company tax number. The payment options are also the same.
The consumer's right to withdraw from the contract
- In the case of distance contracts, the consumer has the right to unequivocally notify the company within 15 days by email (info@boo-care.si) or through another communication channel that he or she is withdrawing from the contract, without having to give a reason for his or her decision. You can download the withdrawal form from a distance contract by clicking HERE.
- The consumer must return the goods to the company no later than 15 days after the notification of withdrawal from the order. The consumer returns the goods to the address: Bastard 9 doo, Stara cesta 96D, 1370 Logatec. If the consumer has withdrawn from the contract in the case referred to in the previous article of this Act, the company must refund all payments made. The only cost borne by the consumer in connection with the withdrawal from the order is the direct cost of returning the goods.
- The consumer must return the item to the seller undamaged and in unchanged quantity, unless the item is destroyed, damaged, lost or its quantity has decreased through no fault of the consumer.
- When returning the goods, the consumer also sends the invoice for the goods and personal data and the transaction account to which he wishes to receive the refund. We will make the refund as soon as possible, but no later than fifteen days after receiving the notification of withdrawal from the contract.
Consumer protection
In this section of the Terms and Conditions, the consumer is the natural or legal person who acquires and uses the products for purposes outside their professional or gainful activity. In the remaining sections, the term buyer includes both the buyer and the consumer.
Bastard 9 doo operates in accordance with applicable legislation and takes care of its users and customers at all times. In case of any disputes, it will do its best to find an amicable solution. Any potential complaint can be addressed by the customer to the published contacts.
Complaints and returns of ordered products
In the event of an error on the part of the provider in delivering products to the buyer, the latter may nevertheless contact the provider regarding this matter, who will resolve the case in the shortest possible time to the buyer's benefit. Contact with the provider in such cases is key to successfully resolving the situation.
Even if the delivered products differ from the ordered products (delivery of incorrect products), the buyer or consumer contacts the provider via one of the published contacts and, in accordance with the agreement, returns the delivered products, which the provider will replace with suitable ones free of charge. The provider also covers the costs of returning the originally delivered products. The originally delivered products can only be returned in unopened packaging.
In the event that the delivered products do not correspond to the properties or specifications of the ordered products (delivery of defective products), the buyer must notify Bastard 9 doo within two months of the day the defect was discovered. If the defect could not be noticed during normal inspection upon receipt (hidden defect), the buyer must notify Bastard 9 doo within two months of the day the defect was noticed, otherwise the buyer loses this right. Bastard 9 doo is not liable for defects that appear after two years have passed since the product was delivered.
Bastard 9 doo is not responsible for any unnoticeable errors in the contents of the originally sealed product.
The consumer or buyer must describe the defect in more detail in the error notification and allow Bastard 9 doo to inspect the item.
A consumer or buyer who has notified the provider of the defect in a timely and correct manner has the right to request that the provider rectify the defect in the product or return a part of the amount paid in proportion to the defect, or replace the defective product with a new, flawless product or return the amount paid.
In any case, the consumer also has the right to demand compensation from the seller for damages, in particular reimbursement of the costs of the product and delivery incurred due to the fulfillment of the obligations referred to in the previous paragraph of this article.
The consumer's rights under the first paragraph shall expire two years from the date on which he notified the seller of the material defect.
Liability for factual errors
The seller is liable for material defects that existed in the goods at the time the risk passed to the buyer, regardless of whether he was aware of this or not. The seller is also liable for material defects that become apparent after the risk has passed to the buyer, if they are the result of a cause that existed before that. A minor material defect is not taken into account.
The seller must deliver the goods to the consumer in accordance with the contract and is liable for material defects in its performance.
The consumer may exercise his rights arising from a material defect if he notifies the seller of the defect within two months from the date on which the defect was discovered.
The consumer must accurately describe the defect in the defect notification and allow the seller to inspect the item.
The consumer can notify the seller of the defect in person, of which the seller must issue a receipt, or send it to the store where the item was purchased, or to the seller's representative with whom the contract was concluded.
The error is real:
- if the thing does not have the properties necessary for its normal use or for trade;
- if the thing does not have the properties necessary for the specific use for which the buyer is purchasing it, but which were known to the seller or should have been known to him;
- if the thing does not have the properties and characteristics that were explicitly or tacitly agreed upon or prescribed;
- if the seller has delivered an item that does not match the sample or model, unless the sample or model was shown only for the purpose of notification.
The suitability of the goods for normal use is assessed in relation to ordinary goods of the same type and taking into account any statements made by the seller or manufacturer about the characteristics of the goods, in particular through advertising, product presentation or indications on the goods themselves.
The provisions of the law governing contractual relations shall apply to liability for material errors, unless otherwise provided by that law.
The seller is not liable for material defects in the goods that become apparent after two years have passed since the item was delivered.
If the subject of the contract between the seller and the consumer is a used item, the seller is not liable for material defects in the goods that become apparent after one year has passed since the item was delivered.
A defect in the item is deemed to have existed at the time of delivery if it appears within six months of delivery.
No contractual provision can limit or exclude the seller's liability for material defects as defined by the Consumer Protection Act.
We resolve factual errors in favor of the consumer in accordance with Articles 37-39, which are defined in the Consumer Protection Act (Official Gazette of the Republic of Slovenia, No. 98/04 - official consolidated text, 114/06 - ZUE, 126/07, 86/09, 78/11, 38/14, 19/15, 55/17 - ZKolT and 31/18)
Warranty
Products have a warranty if stated so on the warranty card or invoice. The warranty is valid subject to the instructions on the warranty card and upon presentation of the invoice. The warranty periods are stated on the warranty cards or invoice.
Warranty information is also listed on the product presentation page. If warranty information is missing, the product does not have a warranty or the information is currently unknown. In the latter case, the buyer can contact the provider, who will provide up-to-date information.
Delivery
Delivery information is available in the “Delivery” section. In cases where the provider dispatches the ordered products on time and in accordance with the contract, it is not responsible for the delivery deadline of the contracted delivery provider being exceeded.
The products will be delivered in appropriate packaging that will ensure the confidentiality of the nature of the product.
If upon receipt of the shipment it is noticeable that the item or package is physically damaged, missing contents or shows signs of being opened, the buyer must immediately initiate a complaint procedure with the delivery service or notify
Bastard 9 doo . Together with the delivery service, we will ensure that the complaint is resolved as soon as possible.
Read the leaflet carefully before use! Consult your doctor or pharmacist about the risks and side effects. Safety data sheets for chemicals, including substances, preparations and biocidal products, are available upon special request from the published contacts.
Bastard 9 doo is not responsible for disruptions in the service that are a result of the user's actions (e.g. a computer infected with viruses) or providers of the path or infrastructure used by the online store service (e.g. an internet outage).
Bastard 9 doo operates in accordance with applicable legislation and takes care of its users and customers at all times. In case of any disputes, it will do its best to find an amicable solution. Any potential complaint can be addressed by the customer to the published contacts.
Bastard 9 doo does its best to ensure that the information on the boo-care.si online store is up-to-date and correct, but due to the specifics of the online store's operations, the characteristics of the items, delivery or price may change in such a short time that the information on the website cannot be corrected. In such a case, the provider will inform the buyer of the changes and allow him to withdraw from the order or find an amicable solution.
Users can alert us to any errors at any time, for which we thank you in advance.
Complaints and disputes
Bastard 9 doo complies with applicable European consumer protection legislation. It makes every effort to fulfill its duty to establish an effective complaints handling system and to designate a person with whom the customer can contact by phone or email in case of problems.
The complaint is submitted via the e-mail address info@boo-care.si. The complaint handling process is confidential. Bastard 9 doo will confirm receipt of the complaint within five working days, inform the customer how long it will take to handle it, and keep them informed about the progress of the procedure.
The Provider is aware that the essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportionality between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle to the consumer not initiating a dispute in court. Therefore, the Provider makes every effort to resolve any disputes amicably.
In the event of judicial dispute resolution, the court at the consumer's permanent residence has jurisdiction.
Out-of-court settlement of consumer disputes
In accordance with legal regulations, Bastard 9 doo does not recognize any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute that a consumer could initiate in accordance with the Out-of-Court Consumer Dispute Resolution Act (ZIsRPS).
Bastard 9 doo, as a provider engaged in online sales in the Republic of Slovenia, publishes on its website a link to the platform for online consumer dispute resolution (SRPS platform). The list of regulations stems from the Out-of-Court Resolution of Consumer Disputes Act (ZIsRPS), Regulation EU No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.
